1. Agreement to Terms

By accessing or using the MUCK platform ("MUCK," "we," "our," "the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use MUCK.

2. Platform Purpose

MUCK is a marketplace that connects home-based food vendors ("Vendors") with customers ("Users"). MUCK does not cook food, inspect kitchens, or guarantee food safety. All food is prepared by independent Vendors.

3. Eligibility

Vendors

Vendors must:

• Be at least 18 years old
• Provide accurate account and identity information
• Agree to all Vendor responsibilities and safety rules

Users

Users may create an account and purchase food on the platform. Parents or guardians are responsible for supervising minors.

MUCK may suspend or terminate accounts for violations.

4. Location Services & Privacy

MUCK may collect and use location data to improve user experience, including displaying nearby vendors and estimating distances. Location data is handled in accordance with our Privacy Policy. Users may enable or disable location services at any time through their device settings.

5. Vendor Responsibilities

Vendors agree to:

• Follow all food-safety laws in British Columbia
• Meet home-kitchen and cottage-food regulations
• Use safe food-handling practices
• Provide accurate ingredient and allergen information
• Label products as required
• Hold any required certificates or business permits
• Deliver safe food in a timely manner
• Provide accurate location information for distance calculations

Vendors are fully responsible for food quality and safety. MUCK may remove Vendors who do not comply.

6. User Responsibilities

Users understand and accept that:

• Food may be prepared in private home kitchens not inspected by government health authorities
• Food may contain or come in contact with allergens
• Users are responsible for checking ingredients and allergens before consuming food
• All food is consumed at the User's own risk
• Distance calculations are approximate and for reference only

7. Payment & Fees

Payments are processed securely through Stripe. MUCK does not store full payment details. Vendors are billed a Kitchen Printer Subscription of $7.99 USD per month to keep their kitchen listed on MUCK, plus a 3.5% transaction fee per sale that is a pass-through covering Stripe's payment processing costs (no additional MUCK markup). Vendors receive the remaining amount after the per-sale transaction fee.

Refunds and cancellations are subject to Vendor policies unless otherwise stated by MUCK. Additional fees (including processing fees) may apply and are non-refundable.

8. Delivery & Pick-Up

Delivery or pick-up arrangements are managed by Vendors unless otherwise stated. MUCK is not responsible for delays, transportation issues, or food conditions during transport.

9. Acceptable Use Policy & Prohibited Conduct

You agree not to use MUCK to engage in any conduct that is unlawful, harmful, abusive, defamatory, or otherwise objectionable. Without limitation, Users and Vendors may not:

• Sell prohibited or unsafe food items
• Misrepresent products, prices, or identity
• Attempt to bypass MUCK's payment system or fees
• Harass, threaten, intimidate, or abuse other users or staff
• Post content that is defamatory, libelous, fraudulent, or knowingly false
• Post hate speech, slurs, or content that promotes discrimination or violence against any group
• Upload sexually explicit, violent, or otherwise unlawful imagery or content
• Post content that infringes the intellectual property or privacy rights of others
• Submit spam, repeated unwanted messages, or automated requests
• Engage in fraud, money laundering, or any illegal activity
• Collect other users' personal data without consent

We may investigate and take action on reported content, including warnings, content removal, and account suspension or termination. Repeated or serious violations may result in permanent removal from the platform.

10. Risk, Liability & User-Generated Content

Users acknowledge that consuming home-prepared food involves risks, including:

• Foodborne illness
• Allergic reactions
• Cross-contamination

MUCK is not liable for any illness, injury, or damages resulting from food purchased or interactions on the platform.

User-generated content. MUCK is a hosting platform and does not create, sponsor, or endorse reviews, ratings, photos, or messages submitted by users (collectively, "User Content"). Users are solely responsible for the User Content they post. MUCK does not pre-screen User Content, and assumes no liability for the accuracy, legality, or appropriateness of any User Content. To the maximum extent permitted by law, MUCK disclaims all liability for any harm arising from User Content, including defamatory, false, or infringing material, and will act expeditiously to remove reported content that violates these Terms or applicable law. You agree to indemnify MUCK against claims arising from User Content you submit.

11. Indemnification

Users and Vendors agree to indemnify and hold MUCK harmless from claims, damages, and liabilities related to:

• Food produced or consumed
• Platform misuse
• Breach of these Terms

12. Intellectual Property

All MUCK branding, features, and content belong to MUCK. Users may not copy or distribute platform content without permission.

13. Account Suspension & Termination

MUCK may suspend or terminate accounts for violating these Terms, unsafe food practices, or legal issues.

14. Dispute Resolution

Disputes will be resolved through binding arbitration in British Columbia, Canada. These Terms are governed by BC law.

15. Modifications

MUCK may update these Terms at any time. Continued use constitutes acceptance of changes.

17. Disclaimer of Warranties

The MUCK platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. MUCK does not guarantee the accuracy, reliability, or availability of the platform.

18. Account & Data Deletion

Users may request deletion of their account and personal data at any time by contacting us at services@muckapp.com. MUCK will process such requests in accordance with applicable laws.
